Human Resource Consulting
  • Contract negotiations;
  • Advice and assistance on administering and managing Human resources filing, which includes maintaining personnel files; leave administration and reporting on any trends.
  • Meeting Management team and staff on monthly basis to discuss and advise on any staff issues or trends;
  • Perusing and advising on current company policies; advise and amend any policies to remain compliant with current legislation; drafting new policies as the business operational requirements require.
  • Implement/ Assist and/or manage performance appraisals.

  • Assistance and preparation of an induction manual;

Industrial Relations Consulting
  • Drafting of all notices to attend disciplinary hearings; retrenchment consultations; Poor work performance counseling or incapacity investigations due to ill health; minutes of hearings and incapacity investigations and retrenchment consultations.
  • Chairing disciplinary hearings and/or Appeal hearings and/or grievance hearings;
  • Chairing or assisting performance counseling sessions;
  • Chairing of incapacity investigations;
  • Wage negotiations and/or other collective or individual negotiations including consultations with the client in preparation for such negotiations;
  • Attendance related to retrenchment consultations; changes to employment conditions; restructuring and transfer of undertaking;
  • Assistance with organisational rights; negotiation of a collective agreement.
  • Assistance with unfair labour practice disputes;
  • Advice on general labour legislation, which includes LRA; BCEA; UIF; Workman’s Compensation and OCHSA; as well as bargaining council specific terms and conditions applicable to the client;
Legal / Litigation Services

This includes all labour litigation, which is handled through Ferreira Attorneys, i.e.:

  • Attendance at the CCMA/Bargaining Councils;
  • Preparation of all litigation matters, including conciliation, arbitration; in limine hearings and applications, i.e. rescissions.
  • Drafting of all notices and applications, i.e. objections to con-arb hearings; opposing or applying for condonations and rescissions; heads of arguments and in limine.
  • Drafting of review applications/ opposing review applications in the Labour Court.
  • Attendance at the Labour Court is excluded from this fee as the client may prefer to brief an advocate whose costs vary and therefore cannot be determined at this time.

Recruitment

Recruitment is an on-going activity which cannot be capped at the monthly retainer hours as it occurs on a continuous basis when the business is on a recruitment drive. Labour Solve therefore levies an administration fee to recover for time spent and costs involved in the recruitment process. This includes:

  • time spent on reviewing and drafting job specs;
  • cost of placing advertisements on behalf of clients [within in reason];
  • reviewing CV’s and compiling a short list of candidates which meet the client’s requirements;
  • doing reference checks on the short listed candidates;
  • assistance and coordination of any pre-employment testing.
Skills Development Planning and Submission
  • Establishment and training of Training Committee.
  • Compilation of Annual Training Report (ATR) past 12 months
  • Compilation of Workplace Skills Plan (WSP) for future 12 months
  • Submission of ATR and WSP to relevant SETA to obtain grants for training spend.
Employment Equity Planning & Submission
  • Establishment and training of Employment Equity Committee.
  • Compilation of Employment Equity Plan; setting of targets and goals for 12-month period and 5-year period.
  • Submission of Employment Report and Plan to Department of Labour.
Payroll
  • Provision of pro-forma payslips;
  • monthly payroll processing, which includes commission based payments; third party payments etc.
  • submission of EMP 201 on a monthly basis;
  • IRP 5 processing on a bi-annual basis;
  • IRP 5 submission to SARS on a bi-annual basis to SARS.
BEE Consulting
  • We partner with a number of rating agencies to assist our clients in obtaining their BEE certificate.
  • We consult to and assist our clients obtaining, preparing and collating the required information so that the appointed BEE auditor can conduct an analysis and issue a BEE certificate to clients.
  • We assist in facilitating the process between the BEE auditor and the client until successful completion of the BEE audit.
  • We furthermore advise on and implement strategies to assists our clients to improve their BEE rating.
Training

We provide training to clients with respect to a number of courses.

  • Managing discipline in the workplace;
  • How to be a complainant in a disciplinary hearing;
  • How to chair a hearing.
